1. Introduction

2. Definitions
“Agreement” refers to these Terms of Service; “Nevada Aerial Media” and "NVAM" refers to our company, known as “Nevada Aerial Media, LLC”; our Website; our Service; or a combination of all or some of the preceding definitions, depending on the context in which the word is used; “Service” refers to the services that we provide through our Website, “Site” refers to our website, www.nvaerialmedia.com; “User” refers to anyone who uses our Service, including general visitors to our Website; “You” refers to you, the person who is entering into this Agreement with Nevada Aerial Media.
3. How Nevada Aerial Media Works
Nevada Aerial Media is a provider of commercial drone services. Our services are intended for customers looking for aerial photo, video, data and mapping across multiple industries. Our Part 107 FAA-licensed and insured drone pilots supply the imagery and data that is sent to the client electronically within project and mission guidelines.
4. Rules of Use
You must not: Violate the laws of the United States, its states, or any foreign political entity having jurisdiction over this Agreement, whether or not the foreign political entity is a country or a subdivision (such as a state or province) or municipality (such as a city, town, county, or region) of a foreign country. Post or send anything violent, threatening, pornographic, racist, hateful, or otherwise objectionable according to the opinion of Nevada Aerial Media. Infringe on anyone’s intellectual property rights, defame anyone, impersonate anyone, or otherwise violate the rights of a third party. Hack, crack, phish, SQL inject, or otherwise compromise the security or integrity of the Nevada Aerial Media Site, Service, or its Users’ computers.
5. Transactions
Unless otherwise stated, all prices published by Nevada Aerial Media or otherwise communicated to you by us are denominated in United States dollars. Nevada Aerial Media will communicate the terms of a transaction to you and you agree that such terms are hereby incorporated into this Agreement by reference. All payments made to Nevada Aerial Media are due immediately unless otherwise noted. Payments via check to be made out to: Nevada Aerial Media. Any payment disputes shall be directed to payment@nvaerialmedia.com.
6. Our Copyright
You must agree to not to copy, distribute, display, disseminate, or otherwise reproduce any of the information on the NVAM Website without prior written permission. Permission requests shall be directed to info@nvaerialmedia.com.
7. Trademarks
“Nevada Aerial Media” and "NVAM" are currently pending service marks registered with the United States Patent and Trademark Office to uniquely identify our Website, Service, and Business. You agree not to use this phrase anywhere without our prior written consent. Additionally, you agree not to use our trade dress, or copy the look and feel of our website or its design, without our prior written consent.
8. Copyright & Trademark Infringement
Pursuant to the Digital Millennium Copyright Act, if you believe that your copyright has been infringed, please contact us at info@nvaerialmedia.com. Please include name, description of content, location of content and contact information.
9. Liability, Warranties and Representations
You agree that you are releasing Nevada Aerial Media from any liability to you in relation to our services, failure of our service and any incidents involving our service.
For Jurisdictions that do not allow us to limit our liability: Notwithstanding any provision of these Terms, if your jurisdiction has provisions specific to waiver or liability that conflict with the above then our liability is limited to the smallest extent possible by law. Specifically, in those jurisdictions not allowed, we do not disclaim liability for: (a) death or personal injury caused by its negligence or that of any of its officers, employees or agents; or (b) fraudulent misrepresentation; or (c) any liability which it is not lawful to exclude either now or in the future.
10. Indemnity
You agree to indemnify and hold Nevada Aerial Media harmless for any claims by you or any third party which may arise from using our services.
11. Choice of Law
This Agreement shall be governed by the laws in force in the State of Nevada. All contracts, offers and services are deemed to have occurred in the State of Nevada. Any services provided outside of the State of Nevada shall be subject to the local and state laws where service was rendered.
12. Disputes
Any disputes that may arise will need to be settled in the State of Nevada through either an arbitration process or small claims court.
13. Force Majeure
You agree that we are not responsible to you for anything that we may otherwise be responsible for, if it is the result of events beyond our control, including, but not limited to, acts of God, war, insurrection, riots, terrorism, crime, labor shortages (including lawful and unlawful strikes), embargoes, postal disruption, communication disruption, unavailability of payment processors, failure or shortage of infrastructure, shortage of materials, or any other event beyond our control.
14. Non-Waiver
Nevada Aerial Media reserves all rights under this Agreement and under the provisions of any applicable law.
